Definitions

Buyer: the person who places an order of the Product

Manufacturer: the original manufacturer of each product

Contract: the firm and final order of a product, made on the Site by the Buyer and presupposing the approval of these Terms and Conditions by the Buyer

Waste: any substance or object in the categories defined in Annex I to Directive 75/442/EEC European which the holder discards, intends to or is required to dispose

Object

The site offers online sales of electrical and electronic goods.

These Terms and Conditions apply to users and buyers of the Site.

The express and irrevocable acceptance of these Terms and Conditions arises:

    For Users: access and browsing the Site;
    For Buyers: the conclusion of an Agreement on the Site.

All contracts concluded on the Site are expressly subject to these Terms and Conditions.

These Terms and Conditions prevail over any other general or special conditions not specifically approved by the Seller.

Seller reserves the right to modify at any time these Terms of Use. These changes apply only to sales incurred subsequent to the posting on the Site Terms and Conditions changed. The buyer is encouraged to read the general terms and conditions applicable on the day and before confirming the order.

The supply of Products and Services

The range of products

Product offers and prices are valid until they are visible on the site and subject to availability.

Prices are in euros, all taxes, excluding shipping costs (removal of deposit). Delivery costs are based on the option and the type of products chosen by the Buyer.

The prices include the VAT applicable on the date of the contract. Any rate change will be reflected in the price of the Products.

In the event that the Buyer would consider exporting the product outside the European Union, the Seller is not responsible for non-compliance of products with the laws of a foreign country. Buyer shall then an importer (or that of intra-Community acquirer) of the Product and agrees to comply with the legislation of the recipient or forwarder of the Product.
Customs duties, local taxes, import duties or other taxes that may be required state are the sole responsibility of the Buyer - importer.

In case of unavailability of immediate product, the Purchaser will be informed by e-mail as soon as possible and order will be canceled unless he chooses to deliver the product within a further period, or, if possible for the immediate delivery of another similar product of equal value and for the same price.

In the exceptional case where the account of the Buyer would have been billed after the property is no longer available and the Buyer does not opt ​​for one of the solutions proposed above, it will automatically be refunded as soon as possible and at the latest within 30 days of payment. Seller may offer coupons with a value equal to the product unavailable. The Buyer shall be free to accept or prefer a refund.

Offering Services

In order to provide a personalized, Interfoto offers a range of services delivery and / or installation fee for which the Purchaser may opt to the Site by checking the appropriate box.

    Delivery Option: Depending on the type and availability of the Product, the Buyer has the choice of removing toll on deposit (by appointment), and various modes of delivery fee (see Article Delivery).
    Option commissioning: The cost of commissioning is indicated before confirming the order. Buyer must have checked the dimensions and methods of fixing required for which the Seller accepts no responsibility.

If option for the commissioning, it further comprises verifying the proper operation and explanation of the start of the unit.

In the event of choice for an option with the introduction of the product it contains no wall or another, or connection to the internet, electric or gas, internal or external.

A buyer who prefers to itself the unit on the fact on its own responsibility.

Compliance and security products

Ensuring compliance:

The Seller shall be liable for defects of conformity existing upon delivery of the Product which is described on the site. Buyer must verify the return of security for the delivery of the Product.

Seller requests the Buyer upon delivery to be mentioned and as soon as possible any lack of conformity (which may in particular result from the packaging or the lack of user manual) by contacting the customer service which will clarify the following information:

    Order Number
    name and address
    reference of the items being returned
    reason (s) of return for non-compliance

The Seller will transmit a reference number and the procedure to follow to ensure optimum management of returns.

Photographs of products contained on the Site are as accurate as possible but can not ensure a perfect similarity with the products, particularly with regard to color. Users and buyers therefore exempt the Seller from any claim in this respect if no substantial difference between the products and photographic representation on the Site, provided that this does not alter the essential qualities of products.

In case of failure to comply, the Purchaser chooses between the repair within 30 days or replacement of the product. However, the Seller may not make the choice of the Buyer if this choice is a cost clearly disproportionate to the other terms, given the value of the Product or the importance of non-compliance. The Seller is obliged to proceed, where possible, according to the method not chosen by the Buyer.

If, in case of major defects, repair and replacement, are impossible, the Purchaser may return the property to be returned and the price within 30 days.

Buyer acknowledges that ensuring compliance is not exercised when using excessive in relation to normal use.

Other guarantees

    warranty against latent defects:

    All products offered for sale on the site benefit from the legal warranty against latent defects under section 1641 of the Civil Code. The Purchaser has a statutory period of two years from the discovery of the hidden defect in the courts.

    This defect will render the product unfit for the use intended or decrease this use so that Buyer would not have acquired or would have paid a lower price if he had known.

    Seller is not liable for apparent defects of products which the Buyer will be able to convince himself.

    Seller reserves the right to refuse any claim manifestly unreasonable or introduced untimely.

    Manufacturer warranty:

    Manufacturer's warranty does not preclude the application of the legal guarantee. The validity period may vary depending on manufacturer. Buyer must verify the return of security for the delivery of the Product.

Conditions of validity of guarantees

The Buyer is aware that these products are sold for normal use by the consumer and does not meet professional use even though some products may have performance "compatible" with a professional. Buyer shall comply with the instructions for use and maintenance of the Product including check storage conditions of the product (heat, humidity, absence of overheating etc ...). In case of non compliance with the recommendations outlined above, the Seller shall be relieved of liability. The burden of proof of compliance with the recommendations lies with the Buyer.

The warranties do not cover:

    the provision or replacement of consumables (batteries, bulbs, fuses, ...)-Damage to a cause external to the device or the intervention of a repairman who has not been previously accepted by the Seller or manufacturer
    normal wear of products.

With the exception of a reference product for non-compliance, the costs and risks associated with the return shall be borne by the Buyer.

Seller will ensure limited downtime of product that may be due to the constraints of Manufacturers.

Takeover bid:

Apart from the exercise of the guarantees described above, in the event that the Purchaser does not wish to keep the Product, the Seller may at its discretion, offer the buyer to return the Product at a discount. It does not in any way be a requirement or an offer applicable to all products.

The product must necessarily be in its original condition and have not been removed, opened or handled in a manner contrary to its use.

Seller may offer this service conditions and prices that will set free and that the Purchaser may reject.

Use or disposal of hazardous waste or harmful to humans and the environment

Product Features

    Eco-design of Energy-using products
    A CE conformity marking shall be affixed and a declaration of conformity issued whereby the Seller ensures and declares that the EuP complies with all relevant provisions in accordance with legal requirements.
    CE marking of Category 1 and 2 radio equipment
    This mark means that the product meets all essential requirements for radio equipment.

Buyer is encouraged to read the useful information provided by the manufacturer that allow it to assess the risks inherent in a product during its normal use or reasonably foreseeable and to take precautions.

Handling processors requires special attention. The thermal paste should be only on the CPU Core (small metal plate at the center of the processor) otherwise it creates a short circuit that permanently cancels the warranty. Cracks or breaks in the core due to poor handling or use by the Buyer are losing the manufacturer's warranty.

Waste Electrical and Electronic Equipment

NB The presence of hazardous substances in electrical and electronic equipment could harm the environment and human health. Users of this equipment can not get rid of with unsorted municipal waste and should use collection systems available to them.

Buyer of electrical or electronic equipment can take back the used equipment seller in the limit of the amount and type of equipment sold. The unit is imperative to return to clean, vacuum, disconnected from the water, gas and electricity and ready for transport.

Disposal of batteries and accumulators

The order process implemented on the Site complies with the provisions of Article 1369-5 of the Civil Code specifying the procedures for concluding contracts electronically.

The ordering process takes place as follows:

    Buyer selects his or her products and validates the shopping cart after checking the contents
    Buyer completes the information about his identity and place of delivery with a telephone number for making appointments

The validation of the payment by the Seller binds both parties to the Agreement.

Payment

The full price is due upon ordering.

There is transfer of ownership only after payment of the full price. However there is a transfer of risk from signing the delivery note.

If paying by bank transfer order will be processed on receipt of payment, upon its receipt. The delivery period shall run from the date of registration of the payment.

Payments by credit card is charged immediately.

Seller's liability

Seller, in the ordering process described above is only bound by an obligation of means.

There is transfer of ownership only after payment of the full price. However there is a transfer of risk from signing the delivery note.

Responsibility can not be engaged by the Purchaser for damages resulting from the use of the Internet such as:

    Loss of data;
    Intrusion;
    Virus;
    Out of service;
    Other problems beyond the control of Seller.

Delivery

Buyer must make an appointment for removal of the Product on deposit.

Buyer may opt for service delivery;

The choice of mode of transport offered to the Buyer is at the sole discretion of Seller.

    Depending on the type and availability of the Product, the Purchaser may opt for a standard delivery or delivery at the doorstep the terms of which it will be made before order confirmation.

The Seller has the burden of risk during transport and until delivery, but the following conditions:

    Buyer must have verified the compatibility of access to the delivery address and especially the size of the stairwell and doors in case of delivery of a large product. The Buyer shall be solely responsible for any inability to access its landing door for the reasons mentioned above
    Buyer or a person authorized to represent must be present at the time and during the timeframe agreed with the seller or the carrier. If Buyer is absent and no authorized person was designated, the delivery will not be possible and the costs of a new delivery will be borne

The delivery involves the transfer of risk to the Buyer. Also, the Buyer is encouraged to formalize notice in writing, meaningful and complete information about the delivery date and signature on any damage, defect or incomplete order packing it could find.

It is also recommended, without prejudice to the applicable legal guarantees, to address his reservations by e-mail to the Buyer and that as soon as possible.

Buyer becomes aware of the cost and terms of delivery before confirming the order. It will also be informed of the cost of other services available to it for which it has chosen as commissioning.

The Buyer will be notified of the date by which the Seller agrees to deliver the product. In case of unavailability of the Product, it will be delivered as soon as the product is available again.

The delivery is accompanied by the delivery of the instructions and whether to surrender the certificate of warranty on the unit.

In case of loss of the package or late delivery, the Vendor will conduct all necessary investigations. The investigation may take several days, the Seller may be dependent on the deadline imposed by the particular position.

Right of withdrawal

The Purchaser shall have a period of 14 days to exercise his right of withdrawal from the date of receipt of the Product or the acceptance of the offer of service.

In case of exercising the right of withdrawal, the Seller will reimburse Buyer for all amounts paid as soon as possible and no later than within 30 days. The refund will be given by any means of payment or with the consent of the Purchaser in the form of vouchers for a product with a value less than 500 euros.

The basis of reimbursement shall include the amount paid. But the cost of returning the product are the responsibility of the Buyer.

The Vendor may also propose a product or service quality and a price equivalent. The cost of returning the goods following exercise of the right of withdrawal shall, in the latter case, the responsibility of the Buyer.

Products must be returned by mail or by a carrier in their original condition and complete (except for packaging white goods, accessories, manuals ...) with a copy of the invoice and sufficient postage. Products incomplete, damaged or soiled by the Purchaser or have been subject to abnormal use other than a single test are not included.

To ensure the return and receipt of the product in the best conditions and to guard against any risk of loss or damage, it is recommended that the Buyer contact the seller to customer service and before returning the product. A return number will be assigned to the product and communicated to the Buyer and any useful information on how to manage an optimum return.

No right of withdrawal will be allowed for:

    Provision of service performance has begun, with the consent of the Buyer before the deadline of 7 days;
    The goods made to the specifications of the Buyer or clearly personalized or which because of their nature can not be returned or are liable to deteriorate;
    The audio or video recordings or software if they have been unsealed by the Buyer.

Processing, security and data protection

Payment security

Archiving of documents

Protection of personal data.

Any personal information or maliciously fancy is likely to cause the closure of the account.

The Seller may terminate the Agreement automatically and without notice in case of incorrect information or if the address change was not disclosed.

Only the people in charge of information processing within the group Interfoto is addressed.

The Purchaser declares that the ability to contract.

Buyer minor guarantees given permission from his parents or the person with parental authority.

Buyers are advised that the personal data they provide to Seller are necessary for the delivery of products and service delivery by Seller.

This personal data is used exclusively to Seller, and if its trading partners.

Under Articles 38-40 of Law No. 78-17 of 6 January 1978, as amended by Act No. 2004-801 of 6 August 2004 relating to computers, files and freedoms, buyers have to a right of access, opposition and rectification of the data concerning them.

Intellectual property and use of the Site

All elements of the Site are and remain the exclusive intellectual property of the Seller.

Users and buyers are not permitted to reproduce, use, distribute, or use for any purpose whatsoever, even partially, the elements of the site they are software, written, visual or sound.

Copyright

The text, images, drawings and the layout and the graphics of the Site are protected by intellectual property law.

Databases

The database established by the Seller are protected by copyright law and by the law of 1 July 1998 transposing into the Intellectual Property Code the European Directive of 11 March 1996 on the legal protection of databases data.

Any extraction can only be limited and performed for private purposes.

Disputes and applicable law

For any claim, Buyer must contact the department responsible for the Seller in accordance with these terms and conditions of sale.

If continuing disagreement between the parties and no amicable solution would be possible, any dispute relating to this Agreement shall be governed by French law and will be appointed by the courts as having jurisdiction pursuant to Article L 141-5 the Consumer Code.

Seller is exempt from liability in case of force majeure, fault of the Buyer or unpredictable and insurmountable third of the Contract.

In case of cancellation of a clause by the court, the clause will be deemed null and void without affecting the validity of the Contract is in doubt. Other provisions of the Agreement continue to apply.
